The Rochester, NY newspaper, “The Democrat and Chronicle,” quoted Professor John Nolon in an article about a land use case in Westchester County. In the town of Lewisboro, a horse farm bypassed the local zoning laws and appealed directly to the State to gain permission to expand its operation. The horse farm, located in South Salem, falls within an agricultural district making it subject to a NYS farmland protection act. As a result, state law can overrule local zoning law.
“Agriculture is one of the only land uses mentioned in the state constitution. Promoting agriculture is something the state values very much,” Prof. Nolon is quoted as saying.
