“I disagree with those who say that the New York law is not likely to be a model for other states. Indeed, there are many states throughout the country that have a similar situation to New York’s, with largely favorable populations and mixed-party legislatures. More important is the fact that the New York law raises the stakes for federal courts’ consideration of Defense of Marriage Act (DOMA) challenges in that far more U.S. citizens will soon be subject to DOMA-based discrimination.”
